Colfax Immigration Release Paths
Immigration detention is a federal custody path distinct from Colfax County detention and NMCD imprisonment. A person may leave VMDC for ICE or another federal authority, remain detained at a contracted site outside the county, or later leave immigration custody under the governing process. Closing the VMDC booking proves only that county custody ended.
No current primary-source evidence establishes VMDC as an ICE contract detention facility. The jail must not be described as an ICE center. An individual detainer or handoff can occur without a standing contract. The person-specific release or transfer record is the evidence that determines whether immigration custody entered the chain.
Check Immigration Custody
Use the ICE Online Detainee Locator System after an official record identifies ICE custody. The locator accepts an A-number with country of birth or a biographical search. Accurate spelling and identity details matter.

Immigration Release Record Sources
Each source establishes a different point in the custody chain. Match dates and identifiers across them before deciding that a release occurred.

A county criminal dismissal does not itself decide federal immigration custody. Conversely, an ICE no-result does not rewrite the state court docket. Keep the systems separate while connecting the person-specific transfer.
VMDC Immigration Transfers
If VMDC records a departure to ICE, ask for the date and time, release or transfer type, receiving agency, destination if disclosable, and authority or order identifier. A focused IPRA request should seek the existing booking and movement record, not ask Colfax County to explain the person’s immigration case.
The county event may be labeled as a release because VMDC custody closed. In plain language it remains a transfer if another authority took the person. The ICE locator and official detention channel then become the appropriate next checks. VINE, when available for the county booking, is only a notification aid and may not describe the full federal destination.
NMCD Offender Search does not cover ICE custody. BOP Inmate Locator covers sentenced federal prisoners, not the entire immigration detention system. Choosing the wrong locator can create a false impression that the person was released.
Immigration Status Meanings
Detainer, transfer, release, and removal are not interchangeable. A detainer signals another authority’s custody interest. A transfer means the receiving authority took control. Release from county custody can coincide with continued immigration detention. Release from ICE custody addresses that federal detention event but does not automatically settle a separate criminal case.

Use the exact agency wording. Do not infer immigration status from a name, birthplace, language, or local arrest. The custody chain must be documented.
Immigration Court Record Check
The New Mexico criminal docket and any immigration proceeding serve different legal systems. The Colfax court can show bond, dismissal, sentence, probation, or commitment in the local case. It may also contain a custody-relevant reference, but it does not function as the ICE locator.
A signed state release order may end the county basis for detention while an independent federal handoff follows. VMDC’s movement entry records the physical county event. ICE records the later federal custody. Check dates carefully, because an apparent gap may reflect transport or database update time.
For certified state documents, contact the filing court. For ICE detention information, use ICE. For the county release or transfer record, use Colfax County. One agency cannot correct another agency’s source record.
Older Immigration Release Records
The live ICE locator is not a complete historical release archive. Begin an older inquiry with the last documented custody record, the A-number when lawfully available, the county booking number, and the relevant case numbers. Ask VMDC for its transfer entry and use official federal channels for the next stage.
A blank current locator result may arise after release, transfer, removal, data delay, spelling variation, or limited coverage. It cannot establish which occurred. Keep a copy of the exact search inputs and seek confirmation through the ICE information line or the identified facility or field office.
Sealed, expunged, juvenile, victim, medical, and security-sensitive material may be restricted under the rules governing the record holder. Request nonexempt portions and a written basis for withheld county material where applicable.
A focused Colfax County IPRA request can ask for the existing VMDC booking and movement record for a named person and date. Useful fields are the release or transfer timestamp, recorded type, receiving agency, destination when disclosable, and authority or order identifier. The county need not create an immigration-case summary. It can produce the records it created and identify lawful redactions. That request is most useful when staff confirm only that the person is no longer present.
The criminal case should be traced independently. A magistrate or district docket can show bond, dismissal, sentence, probation, warrant action, or commitment. None of those labels alone proves the later ICE custody event. The jail timestamp shows physical departure from VMDC, while the state court record explains the local legal event. The ICE system addresses the federal detention stage.
USMS and BOP results may also appear in a federal chain, but they are not substitutes for the ICE locator. USMS handles federal prisoner custody and transport. BOP covers sentenced federal imprisonment from 1982 forward. ICE detention is a separate system. Follow the agency specifically named in the transfer record rather than searching every federal database and treating the first no-result as release.
Identity errors can be hard to correct once records from several systems are mixed. Use the A-number when lawfully available, country of birth as the ICE form requires, exact name variants, county booking number, and court case number. Do not infer that two people are the same from a first and last name alone. If a source record contains an error, direct the correction request to the office that created that record.
Timing can also explain apparent conflicts. VMDC may record the handoff before an ICE locator entry becomes searchable. ICE itself warns that some detained people may not appear immediately. Record the county movement time, the locator search time, and the exact identifiers used. Then call the official detention information line rather than treating the delay as proof of community release.
If ICE confirms release from its custody, keep that event separate from the outcome of the Colfax criminal case. Court conditions, probation, a warrant, or another authority may still matter. The custody record answers who held the person; the case records explain the legal matters that remain.
